Welcome to Brisker. These Terms of Use ("Terms") constitute a legally binding agreement between you and Brisker ("we," "our," or "us") governing your use of the Brisker mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use Brisker. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to keep it up to date. You may not share your account with others or create multiple accounts.
Brisker is a social walking and activity app that lets you:
You may create and share content through the App, including text messages, photos, Brisker descriptions, and location data ("User Content"). You retain ownership of your User Content, but you grant Brisker a non-exclusive, royalty-free, worldwide license to use, display, and distribute your User Content solely for the purpose of operating and providing the App.
You are solely responsible for all User Content you post. By posting User Content, you represent that you have the right to share it and that it does not violate these Terms or any applicable law.
Brisker has zero tolerance for objectionable content or abusive behavior. You agree not to post, share, or transmit any content that:

Brisker provides tools for users to report objectionable content and abusive behavior directly within the App. If you encounter content or conduct that violates these Terms, please report it immediately.
All reports will be reviewed within 24 hours. Upon review, we may take any action we deem appropriate, including but not limited to:
We reserve the right to remove any User Content and to suspend or terminate any account at our sole discretion, with or without notice, for any conduct that we determine violates these Terms or is otherwise harmful to other users or the App.
The App and its original content (excluding User Content), features, and functionality are owned by Brisker and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share your information. By using the App, you consent to the practices described in the Privacy Policy.
The App relies on third-party services including Supabase (data storage and authentication), Expo (app delivery), and Apple Push Notification service. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party services.
The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, Brisker disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant the accuracy or completeness of any information provided through the App.
Safety disclaimer: Brisker facilitates social walking and outdoor activities. You participate in all activities at your own risk. We are not responsible for your physical safety during any Brisker coordinated through the App. Always exercise appropriate caution and judgment.
To the fullest extent permitted by applicable law, Brisker, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or property damage, arising out of or in connection with your use of the App.
In no event shall Brisker's total liability to you for all claims arising out of or relating to the App exceed the amount you have paid to Brisker in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
You agree to indemnify, defend, and hold harmless Brisker and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your User Content, or your violation of these Terms.
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may stop using the App at any time. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including but not limited to Disclaimer of Warranties, Limitation of Liability, and Indemnification) will survive.
We may update these Terms from time to time. When we make material changes, we will notify you through the App or by other means. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
